An Illinois settlement for $30m was reached after a doctor performed a novel procedure on a baby causing brain damage and cerebral palsy. Ezequiel Chavez, currently 6 years old, was born with a defect in his esophagus that is easily correctable by a routine procedure, according to news reports. Instead, the day after his birth, his doctor decided to perform a risky, untested procedure on the baby to correct this problem.During this risky surgery, the doctor used a surgical needle to sever one of the child’s arteries supplying blood to the child’s brain. Because this child’s brain was deprived of oxygenated blood, it caused a brain injury which manifests as cerebral palsy. This Illinois settlement will help ensure that Ezequiel Chavez will have a life time of care and support necessary to address the issues surrounding his cerebral palsy.
